Proposed By-Law Changes

As per the note in the newsletter, the board has proposed a list of changes to the By-Laws that will need to be voted on at the Annual Picnic. Because there are more changes than can fit in the mailer, we are posting the changes here for review.

Proposed Changes

• Removal of “Inc.” and adjustment to the word “Landowners” in all references to the Crescent Beach Landowners Association.
  
• Article III – Membership
  – Remove Section 2 as a duplicate
  "Each paid membership shall be entitled to no more than two (2) votes."
  
• Article V – Duties
  – Move Section 4C to Article 8 Section 5
  (Treasurer) “Shall send notices of dues to members“
  – Following letter designations are adjusted
  – Section 4E wording changes
  (Treasurer) "Shall submit to the Auditing Committee the Treasurers’ report for audit no less than three (3) weeks prior to the Annual Meeting."
  Becomes
  (Treasurer) "Shall submit the Treasurers’ report to the Board for review and approval prior to the Annual Meeting."
  
• Article VI – Meetings
  – Section 2 wording change
  "The Annual Meeting shall be held in August, specific date to be set by the Board of Trustees."
  Becomes
  "The Annual Meeting shall be held the first Saturday in August."
  
• Article VIII – Dues
  – The addition of Section 5,
  "Notices of dues shall be sent to members via the Annual Newsletter."
  
• Article IX – Election of Board of Trustees
  – Removal of Section 1,
  "President shall appoint a three (3) member Nominating Committee at least 30 days prior to Annual Meeting to prepare a slate of candidates for those positions on the Board of Trustees whose terms expire that particular year."
  – Following section designations are adjusted.
  – Section 3A (now 2A) wording change
  "All candidates for office must have been paid members of the Association for at least thirty (30) days prior to the election."
  Becomes
  "All candidates for office must be paid members of the
Association."
  – Section 4B (now 3B) wording change
  "Each paid membership shall be entitled to no more than two (2) votes."
  Becomes
  "Each paid membership shall be entitled to one (1) vote."
  – Remove Section 4C and 4D (now 3)
  "The Nominating Committee shall present the slate of nominees to the President who shall conduct the election by paper ballot.  Nominations shall be permitted from the floor."
  And
  "Tellers shall be appointed by the President to count the ballots and report the results to the President."
